Video in Link

quote:

It allegedly started with her jogging in her toe shoes and sporting headphones. It ended in video of her screaming and being led away in handcuffs. What happened in between is a matter of debate, but video showing parts of the incident is certainly gaining traction online.

Whatever the woman did to get the attention of Austin, Texas police, a witness’ video of cops detaining her on a city sidewalk Thursday morning then escorting her to a nearby squad car indicate she was not happy with their actions.

I was doing nothing wrong,” she said at first to a nearby witness while sitting on the sidewalk with her hands behind her and one officer standing over her. “I was just crossing the street.”

But as police escorted her away while pedestrians passed by, things got ugly.

The Daily Texan, the student newspaper for the University of Texas at Austin, reported that police arrested the woman for failing to provide identification.

Student Chris Quintero, who the Daily Texan reported witnessed the arrest, said he saw the woman jogging with headphones on when police ran after her. When the woman failed to stop, the officer grabbed her by the arm and handcuffed her, Quintero said.

“She repeatedly pleaded with them, saying that she was just exercising and to let her go,” said Quintero, who also shot the video and took photographs of the incident.

.

The woman can be seen in the full video attempting to get up from the sidewalk and being kept down by police officers.

Austin police did not return phone calls from TheBlaze about why the woman was detained.

According to a statement to The Daily Texan from police spokeswoman Lisa Cortinas: “[In this case], the call is titled failure to identify.”

quote:

UPDATE: As TheBlaze pointed out earlier this year, citizens have a variety of rights when it comes to interacting with police, including whether or not you have to show ID, and laws vary from state to state.

According to the infogrpahic in TheBlaze story from January and other sources, in Texas you only have to show ID once you’ve been arrested, not before. If you’re lawfully detained in Texas, you do not have to provide ID. However, you cannot give false information about who you are.

It’s still unclear if the woman in the video was arrested or detained or if she had ID to show or provided information of any sort to police. TheBlaze will update this story when police provide the information.

I've been seeing this story a few places. Why did the cops pursue her in the first place?

Comal county is right down the road. One night outside of the sports bar. The cops waited outside, if you came out and got in a car you got a DWI, if you didn't get in your car and tried walking away you got a PI. The only reason I didn't get it was my then wife and I were arguing and were in the restaurant across the street. Texas cops suck arse.

Town of New Braunfels which a beautiful city by the way

kind of funny how all of these types of stories begin with the pedestrian not being cooperative or being a smart arse. I'm not condoning what some of these cops do, but I imagine that 9 times out of 10, if you just showed them some respect, these situations wouldn't escalate like they tend to do.

Oh, of course. If they arrested everyone in Texas for that, nothing would ever get built.

Just an FYI

Louisiana Revised Statute 14:108 Resisting an Officer

quote:

(c) Refusal by the arrested or detained party to give his name and make his identity known to the arresting or detaining officer or providing false information regarding the identity of such party to the officer.

when you get pulled over in Kenner the officer asks for the IDs of everyone in the car. I told an officer I didn't have to show ID, and I was given a lot of shite for it.

I believe if she would have given the police 60 polite seconds of her life she would have been on her way. She didn’t and spent no telling how much time in custody. Pick your battles better than this lady did.

For what it's worth, the runners and bikers in Austin are some of the biggest douche bags in the world who break the laws all the time.

I've seen videos of cops in London interacting with their citizens and their citizens are treated with respect even when they are guilty. It makes me realize that we are not a free country in at least this one area.

On the flip side, if the police in US big cities treated criminals like the police in London, our police would be killed much more frequently.

The nice thing about "rule of law" is that it eliminates emotional judgement about what is right and what is wrong.

The bad thing about "rule of law" is that it eliminates emotional judgement about what is right and what is wrong.

From a strictly legal standpoint, yes she violated the law right in front of cops who were detailed to ticket violators. Then she compounded her mistake by resisting b/c she was paying more attention to her music than to her surroundings.

OTOH, she almost certainly had no criminal intent.

Personally, I'd chalk it up to bad stuff that can happen when you aren't being careful. It could have been worse, people get run over and killed all the time doing exactly the same thing she did.
