She also struggles mightily with one of the most basic tenets of Constitutional law: That if something was Unconstitutional on its face, it was always Unconstitutional regardless of what a previous Court ruled.

This is the dumbest human that has ever been on the Court.



(Black Codes were blatantly racially discriminatory laws passed in Southern States right after the Civil War)

Also, terribly fricking rude to lay out a question and cut off the answer like 7-10 words in.

Every Senator that approved this dingbat does not deserve to represent the people. Her confirmation hearings were a clown show and now we suffer through the ridiculousness that is Ketanji. Not Justice material. Not even close!

Her problem is that she tries to be to sly when attacking concepts she doesn't like, and she's not quite smart enough to make it work. Like with the "I'm not a biologist" response at her confirmation hearings. What she's doing is trying to attack Bruen by bringing up something controversial to show why that part of Bruen is bad (to her). She just can't complete the argument at all and it comes off really bad.

Ehhhhh that's kind of how Appellate practice is. You're up there arguing and getting cutoff from all sides. Its a tough practice but this is not unusual, its the norm

However someone being this dumb and routinely not understanding basic things is not usual at THIS level

She's trying to argue that Bruen says we have to look at history as to what is constitutional, so she's bringing up blatant Unconstitutional legal history.

She is trying to be sly as you say but isn't smart enough to put it together, and isn't smart to understand that Black Codes were ALWAYS Unconstitutional, so they can never apply.

This is where I disagree. I think she knows they were unconstitutional and that is the angle she's using to attack that prong of Bruen.

She just can't fully conceptualize/communicate the argument, only the attempted gotcha.

Now, now now, let’s not be too quick to dismiss this idea. If we roll it forward a bit her argument is basically we could carve out the second amendment and say Black people can’t own guns.

That would take care of 90% of gun violence in the US not bad

The shame is - she's become the opposite of what woke people promote.

She is not unlike dressing a hood-rat into a Supreme Court Justice robe and saying, 'You'll be able to do everything they can do'.

And when the left go out of their way to promote her - "First black, female Justice", everyone in the rest of the world have to bite their tongue... knowing just how ignorant she is... Her views and always, her dissenting opinions.

They gave the constituents they represent exactly what they wanted. They did their jobs putting her on the bench, whether we like her or not.
