SCOTUS agrees to decide if mail-in ballots can arrive after Election Day

Funny enough this could have much larger implications than just post Election Day ballots.
If they rule that election “day” is the key here then it opens up the entire potential concerns about early and mail in voting as well in the future.
If they treat Election Day as a hard cutoff, then is it also then a hard start date? If they treat mail in ballots as a post marked issue, then what is the rule about when voting can or can’t occur?
The fact that this got to the SC, regardless of the outcome, will have far reaching implications and I am somewhat shocked they agreed to take this up.

Sure make an exception for overseas military absentee ballots, I dont really think thats the issue being discussed.

You’ve literally never voted overseas or even served, have you?
Those are absentee votes and each state has deadlines to apply for receiving and then submitting them.

I have to imagine it ends up being postmark date, due to the uncertainty of delivery times (Especially in heightened mail season like election season).

While I agree, they should set a hard date of election date. Elections should be open to everyone (over 18 constitutionally). however it should not be designed around the laziest people on the planet. Voting should be done in person, with absentee voting with for approved legal reasons.
Mail in voting is a horrible concept. I would further it by removing early voting and making election day a National holiday or at least make voting a 4 day window of Saturday to Tuesday.

There is literally zero reason why troops can't early vote and have their ballots received by or before election day.
There are myriad protocols in place to assure this.

So if they go with postmark date, how long after election day can you keep counting those that are postmarked prior to, forever?

Counting can not ever be allowed to begin until all votes are in. Pretty simple concept.
