Moore says he wouldn’t be surprised if this were a miscalculation by the legislature when it comes to phrasing, and hopes that if a special session is called, it can be rectified.

“When you have thousands of bills, you know, things can happen,” said Moore.“Particularly when it’s a fee vs. a fine, yeah, I can see it happening.”

“And it is strictly because of the way the legislature phrased it,” details Borghardt.“By adding a fine in addition to the current fine up to $1000, it triggered the statutory requirement for a jury.”

Why shouldn’t there be a right to trial by jury? In Alabama that is available to anyone who wants to appeal from municipal or district court to get a trial de novo in circuit court. It really isn’t a burden on the system since few people take it that far.

I actually just did a full criminal status and out of 36 open cases, and only 4 are Misdemeanors.

DWIs are typically pains in the arse or the fee is unethical (charging multiple thousand knowing they'll get pretrial diversion) so I don't take them that often
