LA Legislature may have goofed and made all DWIs triable by jury

A new Louisiana law aimed at raising fines for misdemeanor DWIs could have an unexpected consequence: flooding courtrooms with jury trials.
Signed by Gov. Jeff Landry last month, HB403 increases penalties to a level that, according to defense attorneys, triggers a defendant’s constitutional right to a jury trial, potentially overwhelming the state’s already burdened court system.
quote:
“Not to the effect that it would impact a misdemeanor being tried as a Duncan misdemeanor or having the ability of requiring a jury trial,” voiced Moore.“That was never discussed.”
A Duncan misdemeanor requires that any misdemeanor over $1000 is eligible for a jury trial.
Unless the defendant waives his right to a trial by jury.
Moore says he wouldn’t be surprised if this were a miscalculation by the legislature when it comes to phrasing, and hopes that if a special session is called, it can be rectified.
“When you have thousands of bills, you know, things can happen,” said Moore.“Particularly when it’s a fee vs. a fine, yeah, I can see it happening.”
“And it is strictly because of the way the legislature phrased it,” details Borghardt.“By adding a fine in addition to the current fine up to $1000, it triggered the statutory requirement for a jury.”

Oh look.
Attorneys, who charge by the hour, wrote and passed a law mandating they get to charge more hours.
Whoopsie Daisy!

Seems to be a persistent state since taking office.

Put me on a jury, and I'm voting not guilty unless the BAC was over .15

And people think we need fewer lawyers in Congress…

They fricked up liability insurance so I’m not surprised.

Damn. Only people who apparently have a better idea for getting their car home from the bar than Walt are making that jury. Tough break for that guy.

Why shouldn’t there be a right to trial by jury? In Alabama that is available to anyone who wants to appeal from municipal or district court to get a trial de novo in circuit court. It really isn’t a burden on the system since few people take it that far.

It’s easy to be cynical about this and blame the usual suspects.
But my guess is that this is just more Landry incompetence.

Most defense attorneys charge flat fees, and prosecutors are salaried

Landry never met a lawyer he didn't like.

I actually just did a full criminal status and out of 36 open cases, and only 4 are Misdemeanors.
DWIs are typically pains in the arse or the fee is unethical (charging multiple thousand knowing they'll get pretrial diversion) so I don't take them that often
