NEW ORLEANS — A family searched for eight months for their loved one only to find the Orleans Parish Coroner's Office had already cremated him.

Now, a judge will decide if the office was negligent. Benjamin Pfantz died of an overdose in September of 2022.
The coroner says the New Orleans Police Department collected his fingerprints and told them his last name was "Peantz," just one letter off from Pfantz.

Meanwhile, his family called the morgue several times, but they were told he wasn't there.
By the time the misspelling was sorted in May, it was too late.
On Monday, the coroner's chief investigator said he wouldn't agree they were at fault, but evidence shows he told the family otherwise.
The case is expected to resume in civil district court on Tuesday.

They’ll waste money and win judgement against the city and collect .10 on the dollar 30yrs from now.

What's the damages? What were they going to do with him if he hadn't been cremated?

If only there were other options besides cremation.

The Orleans jury will likely give the family an award equal to a wrongful death award. The overwhelming majority of the family’s grief is rooted in the death. This no doubt added to it, but they’ll give money as if the Coroner’s office had caused his death.

Sounds like pure laziness. The coroner's office couldn't search the September deaths by first name? Maybe even get really fancy and try 'Benjamin P', then narrow it down...

Should have tattooed his surname on his extremities.

A sort of Safety Pfantz.

Only if the grieving family is black will a judge offer any money to settle the case. Orleans lady justice is color blind not visually blind.

Coroners five key accomplishments:

1. Lose a dead guy.
2. Cremate wrong person.
3. Show no ability to use common sense.
4. Cause a lawsuit against the city.
5. Lie to family of deceased.

I have no idea who he was or the family, but that was someone’s kid, pal. We all have our demons … trying showing a little empathy, compassion, and respect.

They didn’t lose anyone. They were given a body and a name.

The name they were given was incorrect.

The family was searching for their son. They didn’t know he was dead.

2. Cremate wrong person.
The name they were given was Benjamin Peantz. That name had no one searching for him. After a period of time, when a body goes unclaimed, they cremate.

3. Show no ability to use common sense.
What, exactly, would have prevented this?

The only thing I can think of is the police not misspelling his name.
quote:

4. Cause a lawsuit against the city.
They followed their protocols.
quote:

5. Lie to family of deceased.
How did they lie?

LSUtoBoot didn’t know Scruffy worked for the coroner’s office, sorry for the hurt feelings. Have a nice day.

Scruffy would have to live in that shithole city of New Orleans to work there.

Not a chance of that.

Just spitting facts and countering overly-emotional menstruating.

One of our high school friends dad died in a plane crash many years ago, they were loaded but the ole man was kind of a jerk.

He made money overseas and spent 80% of his time gone, I'm sure he was banging sluts and it was rumored that he had another entire family somewhere.

Anyway, when we went to the gravesite (during the funeral) they had already placed his headstone which had his name spelled one way (right) on the front and another way (wrong) on the back

I doubt they ever had it fixed
