It is my understanding that you can cut any tree over your property at any time. So iff you are truly worried about it, simply have it cut!

Just noticed it today and snapped some pics. Unfortunately they haven't responded to my inquiry yet on this Fathers Day. However, I'd like to know what is the standard before I engage in a conversation with them

I’m sure the experts will weigh in pretty quickly. But, if there is no proof that the tree is in bad shape from an expert, then the damages will fall on you/your insurance. You would need an arborist opinion, then notify via certified mail to absolve you and your insurance carrier from liability.

To the poster that said you can cut any portion over your property. Depending on the jurisdiction, that may not be true. In certain jurisdictions, you would need permission from them, or they could sue you for damages to their tree.

Different jurisdictions have different rules.

Where I live, if I tell the owner of the tree there might be an issue and I’m concerned, then I’m absolved of any damages should it fall. It’s on the owner.

No opinion on the overall issue, but just wanted to point out, this is what willows do. They can live most of their healthy lives jutting out from the rest of a forest. The interstates in La. are lines with jutting out willows.

What does the HOA use for that "greenspace" other than not maintaining that land? almost that entire tree is on your property line.

You're entitled to cut down anything that goes over your property line, regardless of an HOA. Usually it's just branches that cross over your fence and you can trim there, but that's a whole arse tree.

I would probably talk to the HOA about cutting it down completely.

Tree falling is considered an act of God for insurance purposes and on your property or not, your homeowners will be responsible......unless the tree is dead or damaged and you get an arborist involved to inform the HOA. Then you may be able to get the HOA to pay if it fell on your property but that's a big IF.

Better option is to inform the HOA and hopefully work with them to cut the tree down.

Knowing how HOA's work. They will probably ask you to get a lot survey to prove it's on HOA property.

HOA Person: Looks awful close to being on your lot and we don't know for sure if your fence is on the lot line

Suggest you keep up-to-date on your termite inspections and treatments with all the downed lumber adjacent to your building and property in general.
