It’s unclear at this time if any other arrests are pending. BRPD continues its investigation into the incident.
Last comment, all the article said is Repath stops (moving backwards I assume) and attempts to hit MM. There is a lot we don't know here with lots of possible outcomes.
If MM is still moving towards Repath in an aggressive manor when Repath stops to swing (MM ducks, but if he close enough to duck that could mean he is moving towards Repath). If so that swing that can be determined an act of self-defense.
On the other hand if MM and his friends stop moving towards Repath and Repath stops and lunges at them that changes the situation. I suspect the truth is somewhere in the middle which doesn't really help either side.

I didn't read the affidavit or watch the video but Marsig does not want this to go to a jury trial. I served on a jury this past summer in which 4 folks wanted to completely ignore the facts and make a decision based on emotions. We eventually got one to swap so we could render a verdict but it was a pain in the arse. If the prosecution does a good job of making the jury feel sorry for the kids/mom they may get the jury to find him guilty regardless of the facts.

Juries are a rodeo but MM at least has Louisiana requiring unanimous verdicts now. Assuming the initial sucker punch by Repath being allowed in, I feel confident thinking MM would be fine
If the sucker punch can’t be included, and it’s just the second punch /backing up back and forth I would think there is a chance, still small, but chance he is convicted

Yeah, we all know lawyers will try to spin everything but, from what we know, this seems like a classic case of FAFO or Don't Start No Shyte Wont Be No Shyte. And though both were of legal age, the mind / maturity of a 26 year old to avoid these situations is far greater than that of a 21 year old. MF couldn't fight or handle his booze.

They would have to allow the initial punch in, otherwise, how would they explain why Repath would be trying to get away from MM? It would make zero sense. Regardless, even if it's left out, if someone swings on you, and then you only push them, unless you are pushing them off of a bridge, I don't think he should even have to go to trial.

Sounds like the guy's death was nothing but a freak occurrence of a drunk guy falling back and hitting his head on the pavement, that happened to coincide with getting shoved.
I can't envision a situation where the guy who pushed him gets convicted of murder, if the dude he pushed had just swung at him prior. I'll be shocked if there are even charges brought here.
It's not really FAFO, except to the extent that a 26 year old married dude with kids should never be in a situation where he's taking swings at college kids in a college bar. Otherwise, it's just a very sad deal all around. You really have to feel as bad for the Marsaglia kid, as anyone here.

I don't want to get into the weeds on this because I am not licensed in LA and not a criminal lawyer. However, as I have said the timeline and events between the initial punch and the blow that resulted in death are incredibly important. The last facts posted (AFAIK still uncited) imply that there was some period of time where the "fight" was not ongoing and Matt and his crew seemed to have decided to go finish the matter. The time period and the chain them down/backing them down may have indeed shifted the right of self defense/defense of others to Repath. The video and witness statements about that period of time are incredibly salient and the whole case turns on facts that we simply don't have beyond inference.
Using my gut to fill in the blanks along with the specific phrases the police used in the report (as reported by WNRZ) suggests to me Matt and his crew screwed up the courage to go finish the matter and hunted them down in the bar. All this is simply a guess. We simply don't have enough substantiated facts to apply law to the final blow. Now if we had the video and all the witness statements we could probably do a lot better.

It’s a terrible tragedy. But the victim started it apparently. I hope he gets off on the manslaughter charge.

If there was substantial time, why would the arresting report not make sure to cite that? Usually they only leave out important info like that if it isn’t helpful for the arrest, correct?

This really changes my outlook on the events. I wouldn't be surprised if a grand jury doesn't moves forward with this, if this is how it works. Let them fight it out in civil courts but don't waste tax dollars on this.
