Excessive litigation costs the Louisiana economy $5.17B per year

Citizens Against Lawsuit Abuse, a nonpartisan group focused on tort reform, has released a series of city-specific economic impact reports for 2023 that provide a snapshot of the cost of frivolous lawsuits in Baton Rouge and New Orleans.
The reports follow an annual Judicial Hellholes report from the American Tort Reform Foundation in December that ranked Louisiana as the seventh worst state in the nation for “places where judges in civil cases systematically apply laws and court procedures in an unfair and unbalanced manner.”
The Citizens Against Lawsuit Abuse reports show the gross product lost to excessive tort litigation in Louisiana is about $5.17 billion each year, with $3.54 billion in direct costs.
The losses equate to $268.6 million in lost state revenues, and $224.2 million in local revenues statewide. The excessive tort costs equate to a “tort tax” of $1,263 per Louisianan, and translate to 48,696 jobs lost, according to the reports.

Found the plaintiff POS. Surprise, insurance companies don’t want to be in Louisiana because they’re tired of getting the shite sued out of them by the billboard clowns. Until that’s reigned in, nothing changes.

Despite the name, they didn’t reform torts to any significant degree. As long as doctors can charge what they want, insureds can be threatened with excess exposure, promiscuous doctors are willing to relate any and all manner of symptoms and treatment to an accident based on nothing more than a self-interested claimant’s subjective complaints of pain, etc., we aren’t going to reform anything.

There should be a consequence for bringing BS lawsuits. Enforce a "loser pays" system.

THIS is the perfect explanation of the issue with our system. I got hit by a guy WHO DROVE INTO MY LANE while I was driving one of my company vehicles. He started complaning of "back pain" as soon as they learned it was a commercial vehicle. My insurer settled for "policy limits" and told me I was on my own for excess awards if I didn't agree to the settlement. Dude and his lawyer and insurance lawyers all get a fat check. My rates increase by 40%. Total shite.

Yeah that case is leading to a lot of pain for that firm. Likely criminal prosecutions ultimately. The system isn't protecting them.

This is an issue, but this isn't a LA thing specifically. Also this is not your typical plaintiff thing like MV/BI. This is the top tier of trial firms. Those guys aren't taking minimum policy fender benders.
There are 2 main problems other than the framing things I noted above:
1. The numbers cited are pretty much fan fiction, but speculative at best.

2. How do you fix stuff they're complaining about?

I get the MV/BI abuse on small scale torts and PI mills, but those guys aren't filing these suits, either. How do you stop non-frivolous litigation against "small businesses"? Also these are government suits by individual parishes. Also, their primary complaint is that these suits aren't heard in federal court, but a very conservative USSC denied that argument.

What's funny is if you bring this up to the people getting rich over this, they blame the Insurance companies. This state will never be anything more than a dumpster fire when it's most prominent industry is Injury Law.
