Louisianans have always been suckers for the insurance industry. They spend millions of your premiums to put out these “investigations” and make the average citizen think trial lawyers are the reason your premiums go up every year.

Newsflash: Louisiana has some of the toughest tort laws to collect damages on in the entire country.

Apparently they do that in parts of Europe but haven't researched to know for sure.

This sounds like a red herring BS, other states are just as filled with lawyer billboards and don’t complain that it’s screwing their economies.

Can we get some examples of these toughest tort laws that make it so difficult to collect damages in Louisiana?

THIS is the perfect explanation of the issue with our system. I got hit by a guy WHO DROVE INTO MY LANE while I was driving one of my company vehicles. He started complaning of "back pain" as soon as they learned it was a commercial vehicle. My insurer settled for "policy limits" and told me I was on my own for excess awards if I didn't agree to the settlement. Dude and his lawyer and insurance lawyers all get a fat check. My rates increase by 40%. Total shite.

Were you at fault?? Why did your insurer pay anything?

I’ve been a defense lawyer in this state for a long time. This is a laughable statement.

The root problem in this state is that judges are politicians, and politicians love money. States where judges are appointed rather than elected do not have as many problems with nuclear verdicts, and the plaintiff’s bar is not the state’s biggest industry.

Calling something "tort reform" doesn't make it so. The "republican" plaintiff attorneys who populate the legislature will never allow anything meaningful to pass that would hurt their personal bottom lines.

The issue lies primarily in the continuing decline of medical education in this country. Your average physician who graduated medical school post-2000 is a far cry from the doctors of the 70s, 80s, and 90s.

They bring the “practice” back to the practice of medicine

Not according to this insurance industry funded lobbying publication:

Florida, California, and New York produced the most nuclear verdicts in the study period, with a combined 575 verdicts worth over $10 million;
Noneconomic damages are typically the largest component of a nuclear verdict—in fact, i

Yeah no chance this is accurate

You're paying policy limits on a commercial policy for an accident that's 50/50 liablity at best for the Plaintiff?

You either had the worst lawyer of all time, extremely low limits, or are lying.

I mean LA has some of the least Plaintiff-freindly medical malpractice laws in the country. The caps are ridiculous.

I'm a defense lawyer, who does med mal work, and even I can see that.

At this point, it isn't about electing v appointing. It needs to be about getting smart and fair judges.

If you aren't a lawyer, you probably don't realize this but what I'm going to say is 100% true.

There is a saying that As make good judges, Bs make good professors and Cs make money. In Louisiana, this couldn't be further from the truth. It's As make good professors, Bs make good money, Cs make absurd money. Then who is left to run for judge??? Ds. People who weren't hired by big firms. People who aren't good enough lawyers to be sought after. People who aren't smart enough to run an efficient solo practice. Every election is a who's who of morons and failed attorneys.

It's a true those who can't do, judge kinda deal.

Can only laugh when you see these fundraisers for the judges that are heavily sponsored by the plaintiffs attorneys. I mean can the conflict of interest be any more blatant?

They aint dropping, what dont you get about terrible jury verdicts and dirtbag plaintiff attorneys scamming the system with 1) chiropractors and pain quacks or 2) dirty public adjusters.

Fix the system and stop schools and sports teams taking money from these dirtbags.
