From r/legaladvice:
quote:

I had to take a random alcohol and drug test at work and blew a 0.249% and I was stone cold sober. I left work and went to a clinic to prove the false reading and blew a 0.00% 1 hour later. Still got fired.

Exactly what the title says. I received a random alcohol and drug test at work. No problem, I knew I’d pass. Well, I went in and blew a 0.249%! I explained that there is no way this is true because I do not drink and I was obviously sober. They didn’t believe me and made me leave work. My boss told me to go to a clinic within the next hour to get tested. I did and blew a 0.00% at the clinic. I still got fired.

Can somebody please tell me what the hell is going on and what I should do? I never drink alcohol, so there is absolutely no way that 0.249% BAC was accurate.

Thanks in advance.

**EDIT: I had to take an Uber from work to get to the clinic. Just answering everybody that is asking why they let me drive.**

Louisiana. It was performed by a 3rd party that is contracted by the employer. All I know is that my boss told me that I blew the highest ever recorded BAC at work. None of this makes sense. I was completely sober.

You would think with that BAC reading, they’d ask you to retake it. that’s legit drunk.

Yeah it would be very obvious if someone had that BAC level.

I actually had one come back showing heroin in my system.
I've never done heroin in my life, so I knew it was incorrect.

I felt like the poppy seed episode on Seinfeld.

At 0.25 you’d have trouble forming sentences and would for sure be visibly drunk

For comparison, Maddison brooks BAC was 0.32 and she was incapacitated

That’s what I was thinking.

.249 would be outwardly noticeable for most people.

If he has a 12 year old brother he is willing to put up as a retainer, there are a couple of attorneys on the poli board that will take his case.

Might be hard to win in an at will employment state but that guy might want to go for defamation of character.

Depends based on...

Why the random test?
Who else was selected?
How were the selections performed?
What is in the handbook regarding testing?
Is there an employee handbook?
Does the company have a PEO?
Was the PEO notified?
Did the PEO sign-off on the decision?

Lot's of questions...
