Wife involved in hit-and-run

Female driver behind her wasn’t paying attention and rear ended her. Wife got frazzled and before she could process what happened, the other driver sped away. She go ZERO details on the make of the car, but luckily, the car behind her (Cadillac) actually had a pic of the perpetrators tag from camera which was used in the police report and ultimately, to name the perp. Other person’s State Farm auto insurance was contacted and my wife’s insurance cut her a check for the damages in the meantime. Couple of weeks ago, she got a call from perp’s insurance asking for a statement, which she gave.

Yesterday, we get a letter from perp’s insurance saying that unless we could provide additional evidence “like a video”, the claim against the perp’s insurance would be denied and insinuated that our claim was false.

We’ve already received a check from our insurance…why would the perp’s insurance send us this letter?

Because insurance will do anything they can to not pay.

You could always call the driver who ran and tell them they can admit it to their insurance company or you can get the cops involved and the police report can prove she did it, but it will be after she’s charged with a criminal offense.

Her call.

Send it to your insurance company. They should be handling this is you already filed a claim with them.

Your insurer, is subrogation into your rights against their insurer. Basically they take your place, That happened when your insurer paid you for the incident. The other drivers insurance doesn’t know that you’ve been paid yet so You need to forward that to your insurance and just stay out of it but send everything to them.

Because tort reform allows them to do BS like this and to shirk accountability while collecting huge premiums

Your insurance company may have decided not to pursue subrogation since it was $1500 of damage. Assuming you have a $500 deductible, they’re out $1,000 and the back office admin might not be worth it.

Odds are your car rental will cost more than the repair. Did your company pay for that?

Their insured made a fraudulent statement denying the hit so that’s all they have to work with. Tell them you have third party witnesses. State Farm is the most difficult company to deal w when you are going after them.
