Dollar General Employee Charged With Manslaughter After Killing Armed Robber, Says 6th Time In 5 Months Store Was Robbed
According to local police, Rafus Anderson was working at the downtown Monroe location when the robbery took place. Per Fox 5 Vegas, when the thief took the money from the register and attempted to leave the store, the employee pulled out a gun and fired more than one shot in his direction. The suspect was hit along with an innocent bystander who was shopping at the time.

If you are ever in a position to rely on self defense, it's not a good idea to shoot the aggressor in the back while he/she flees.
It doesn't automatically screw you, but you can get convicted. Remember that incident in Oklahoma (IIRC) a few years ago?

That's a fact.
The heat of a moment is hard to always know how to respond in, but you do need to have major calculations going on if you want to be a responsible gun owner. Now, I don't agree that you should get charged. Personally, if you present an armed threat I don't care if you're running away. That is a live session of threat, and it's fair game. but legally, you are very right.

That dude got rung up because he shot a robber in the head, completely incapacitating (but not killing) the perp. He then went and retrieved an additional handgun and executed the guy.
I'd say that's a bit different.

yeah not good to shoot in the back and aim must have been bad since he hit a bystander too.

Sure but the general point remains. Once the immediate threat of the aggressor is over, what you can do in response decreases a great deal.
The available "defense" options in the example in OK were much more limited than the story in OP.

Defense counsel will successfully argue that the clerk was in a traumatic state of shock and still felt threatened for his life.

Even though the deceased was committing a crime, the survivors will be suing DG and they will win a lot of money. I'm guessing somewhere north of a million.

It is not beyond the realm of possibility that the armed robber could stop, turn around and shoot somebody as he’s going out the door.

Armed robbery should supersede shooting someone in the back. If you stick a gun in someone's face and steal their money, a potential outcome of that could be getting shot in the back when you turn to leave. If the clerk had attempted to draw their weapon while the robber was facing them, they could have been shot.

Who's to say he doesn't come back in to eliminate witnesses?
Apparently fleeing isn't necessarily fleeing.

That validity of that presumption is certainly subject to reasonable debate.
