No

In fact you could be a regular user and not be high at all and be convicted of driving under the influence since there isn't a test that can show you were high at the time in question.

The blood test only shows you have it in your system.

It's Colorado. I can smell weed everywhere when I'm there.

Hell, yesterday morning I was in LAX Airport and smelled weed in the airport while checking in.

Even if you think the cops are wrong with their commands, you still need to comply. Arguing and fighting with them will only lead to trouble. It`s very obvious a lot of these guys want a confrontation so they can possibly sue the police and get the officer fired.

Slight smell of odor is not a reason to search imo, less other signs of impairment. If it’s a STRONG odor from a distance, that’s a different story.

First, the guys were acting a bit strange from the officer perspective.

The second officer could easily smell it when he arrived on scene from estimates 30-50 feet away. DUI investigation was appropriate.

Driver refused to be detained and then resisted and fought 3 officers. FAFO. arse kicked and arrested.

Passenger followed officer instructions and was detained, then released.

Simply follow officer instructions and don’t drive under influence, especially with no damn tag!!

YOU WON’T LIKE THE OUTCOME WHEN YOU FIGHT THE COPS!! If they are wrong, you have your chance to prove it later.

Well the Civil Rights attorney says his client "didn't feel like he did anything wrong" so there you have it.

The win/loss record with cops when you get co for rational during the stop is 0 wins and all loses. Right or wrong, roadside isn’t the place for that battle.

Hell, a good friend of mine got pulled over just into OK from TX for “passing too closely”. The troopers were hunting for weed. Friend had $20k in his truck, cops made a stink about it. My buddy asked if either of them had a $20 on them. One said yes, my buddy said when you compare net worth, that $20k is relatively less of my net worth than the $20 is yours.

Apparently that didn’t go over well.

Any officer, in CO and other legal states, cannot use the smell as a sole reason to conduct a search.

The way I read that article it seemed that the ruling was only for dogs.
