This veteran simply had to fill out an application for approval but chose to engage in a pissing contest with his HOA. Seems pretty stupid but have at it pal.

No. What this veteran did is protected by state law. He owes no lip service to some goddamn busybody.

Never ceases to amaze me that people want to buy a house in a nice neighborhood with an HOA and then bitch about rules that the HOA has established.

The right to display a flag gives him a right to violate the HOA addendum he contractually agreed to abide by when he purchased his property?

Absolutely. Especially since the state law specifically mentions flagpoles and his is in compliance with state law. Do you not understand that just because something is put in a legal document, it doesn't mean it is enforceable? Do you think a landlord could put a clause in the lease that specifies oral sex is required if the rent is late? Even if the tenant signed the lease, it isn't enforceable as it violates the law.

Well according to your retarded logic, that shouldn’t be a problem. I don’t have to pay the rent because that lease isn’t enforceable.

As I suspected, this is one of those flagpoles in the front yard.

If you want to fly a flag, put it on the front of your house like a normal person. Those guys who try to make their house look like an official building with the flagpole are eyesores.

There is a difference.

And this is the essence of what's wrong with HOAs you have people that live in your own neighborhood that form a quote unquote board but when one of them decides to make changes to their property that are also against HOA rules and it causes damage they go mia

I loathe HOAs and will never buy a house that has one but if he bought into one then that's on him. If he owned prior to the HOA going into effect then I feel bad for him but you can't choose to buy into one and then complain about the rules.

ETA: What are the federal and state rules on the size of the American flag being flown? Are there limits? If not then ignore everything I said above. If there are then my point stands.

Not sure I've ever met an HOA lover.

I’ve rented a few houses while in the military and never had problems living in an HOA, but I also never understood why HOAs would let owners rent their properties.

"If you like something you have to defend it in every instance!"

Your threads are tiring. My child had a better grasp of nuance at age 6 or 7.

This is retarded. You know I understand why hoa's exist but inevitably they end up populated by assholes like you and completely ruin themselves

Why I hate them:

My SIL died, she had been active in the town and her death was in the local papers.
Four days after the funeral she received a HOA warning that if she didn't go out and put the basketball net back to vertical she'd be fined $100.

I responded something to the effect that they were welcome to go after her to collect and I named the Crematorium that had been used. I also said that if they were worth a **** as neighbors, they'd get off their lazy posteriors and walk the ten feet from the public sidewalk and put the thing back up.

We were handling the estate and it was not billed by the HOA.

If you move into a neighborhood and know the HOA rules coming in, then you have no excuse. I am more patriotic than most, but some neighborhoods have limits on size and locations of signs, flags, etc.

I knew a pharmacist that lived in a HOA and they fined him for having an “unapproved” landscaping company to redo his backyard.

He and his lawyer reread the charter with a fine tooth comb.

He later build several birdhouses built on 15 ft poles with all different kinds of brilliant colorful colors. Of course they were above his fence and visible but there was nothing in the charter forbidding it in his backyard

This same HOA fines his neighbor for pulling out a basketball goal and not closing his garage door

I hate to be "that guy" but it is an interesting dichotomy between the hoa rule to submit an application and the law that allows the pole and flag

In what world should he be required by the submit a application for something that the HOA cannot legally deny?

The situation only escalated when the veteran refused to remove the flagpole, accruing $1,000 in fines. The HOA responded by initiating a lawsuit for $8,000 and threatening to place a lien on his property.

Orlando Law Managing Partner Jennifer Englert told WOFL-TV that this action may not be legally defensible. Englert explained that Florida statute says as long as the flagpole is under 20 feet, a homeowner can have a flagpole on their property, even if the HOA has rules against it.

So, they’re suing him for $8,000 and threatening a lien? He should counter sue for $8,000,000.00. And I’m not talking sue the HOA, sue the members of the HOA personally. Bankrupt them. Take their houses and throw their miserable asses out on the street.

Like this hasn’t happened before. Make sure you know who’s putting the flag pole and flag up before you try to push them around.
