Absolutely. Especially since the state law specifically mentions flagpoles and his is in compliance with state law. Do you not understand that just because something is put in a legal document, it doesn't mean it is enforceable? Do you think a landlord could put a clause in the lease that specifies oral sex is required if the rent is late? Even if the tenant signed the lease, it isn't enforceable as it violates the law.

I loathe HOAs and will never buy a house that has one but if he bought into one then that's on him. If he owned prior to the HOA going into effect then I feel bad for him but you can't choose to buy into one and then complain about the rules.
ETA: What are the federal and state rules on the size of the American flag being flown? Are there limits? If not then ignore everything I said above. If there are then my point stands.

Why I hate them:
My SIL died, she had been active in the town and her death was in the local papers.
Four days after the funeral she received a HOA warning that if she didn't go out and put the basketball net back to vertical she'd be fined $100.
I responded something to the effect that they were welcome to go after her to collect and I named the Crematorium that had been used. I also said that if they were worth a **** as neighbors, they'd get off their lazy posteriors and walk the ten feet from the public sidewalk and put the thing back up.
We were handling the estate and it was not billed by the HOA.

If you move into a neighborhood and know the HOA rules coming in, then you have no excuse. I am more patriotic than most, but some neighborhoods have limits on size and locations of signs, flags, etc.

I knew a pharmacist that lived in a HOA and they fined him for having an “unapproved” landscaping company to redo his backyard.
He and his lawyer reread the charter with a fine tooth comb.
He later build several birdhouses built on 15 ft poles with all different kinds of brilliant colorful colors. Of course they were above his fence and visible but there was nothing in the charter forbidding it in his backyard

Like this hasn’t happened before. Make sure you know who’s putting the flag pole and flag up before you try to push them around.
