You can find a transcript of the first hearing in JGG v Trump - the first case filed challenging the AEA.

The government repeatedly states habeas is the appropriate judicial review under the AEA.

You can also see it in the filings made by the givernment in the case.

But you cannot certify a class action under well settled habeas law which is what the ACLU is attempting. Habeas petitions are necessarily individualized filings. The putative class the ACLU is filing on behalf of is absurd.

I agree. Was just making clear that the Trump Administration has taken the position from the start that habeas is appropriate under the AEA. One of the talking points the media feeds ignorant people is that the government is against due process.
