Obviously, this stop did not happen in Texas, but the DPS provides advice for similar situations:

State law requires a driver to immediately stop when approached by an authorized emergency vehicle and you may be arrested if you do not stop immediately. If you feel the area is unsafe to stop immediately or if you have concerns the vehicle is not a real police vehicle, you can take the following steps to minimize the risk of being arrested or charges being filed against you: turn on your hazard lights and drive slowly and carefully below the posted speed limit; you may call 9-1- 1 and remain on the phone with the operator while you stop and verify the officer’s identity; you may drive to a nearby well-lighted, populated place to stop.

Screw that guy. He wanted to be a victim in that situation. Cops did nothing wrong, and I’ll call a cop out in a heart beat. They should be held to a very high standard...but people do not get a pass for being idiots.

So that means it was simply because he stated it was?

Let’s assume you think he was actively trying to elude the police. Per Virginia law:
quote:

§ 46.2-817. Disregarding signal by law-enforcement officer to stop; eluding police; penalties.
A. Any person who, having received a visible or audible signal from any law-enforcement officer to bring his motor vehicle to a stop, drives such motor vehicle in a willful and wanton disregard of such signal or who attempts to escape or elude such law-enforcement officer whether on foot, in the vehicle, or by any other means, is guilty of a Class 2 misdemeanor. It shall be an affirmative defense to a charge of a violation of this subsection if the defendant shows he reasonably believed he was being pursued by a person other than a law-enforcement officer.

Yes, that was why they stopped him. He had a temp plate in his back window. Perhaps the tint was too dark so they couldn’t see it from the road. They likely could once they pulled up to the gas station. So at that point, they have him on too dark of tint on his car. That’s it.

Of course, if he was driving like a manic trying to elude them, that’s different. But judging from his reaction in the video, I doubt that was the case.

It is a felony with a vehicle in Texas but an element is intent to evade.

I guess lacking intent would be failure to comply with a peace officer’s lawful order.

Like I said, the officers probably overreacted. But frick that guy. Refusing to get out. Telling them it was no way to treat a veteran. Stopping them from opening the door. What an arse. I’ve been pulled over at least 8 times in my life and always just did what was asked and had no problems.

You think a temp plate on the INSIDE of a tinted window at night with flashing lights reflecting off it would be easily visible?

No, on the road it wouldn’t be. I said that already. Stopping him was justifiable. Once they did though, they could see the temp plate, write him a ticket for the tint, and the situation is over. No need to draw guns and start screaming as if the guy was coming to attack them.
