Unless the Senate goes back to requiring a two thirds majority to install federal judges we'll always have this partisan system we're into now. The two thirds majority forces bipartisanship and compromise. Simple majority does not.

Problem is that such "compromise" candidates (of they even exist) invariably trend to the left.
You are either a constitutionalist, or your aren't.
And it was never 2/3. It was 60 to get past a filibuster (Senate rule) and you can thank Harry Reid for the current situation.

I think whats more likely is the government tells Brian they consider him an out of control rogue judge and he no longer has any jurisdiction in this matter..
He has no enforcement arm available to him. Ther government has a ruling from SCOTUS on the matter and they consider it closed.
