Instead, they have relied on data from the American Community Survey, which annually asks detailed questions, including on race, ethnicity and citizenship, of a small statistical sample of the public.

On Friday, lawyers for California and the Justice Department will present their final arguments in San Francisco in the state’s suit, California vs. Ross, that seeks to block the change. At the same time, the Supreme Court justices will meet privately to weigh the administration’s request to decide the issue on a fast track in the case from New York.

Solicitor Gen. Noel Francisco said the high court must act now because the Census Bureau needs to begin printing forms by summer.

I’m anxious to see how Ginsburg comes down on this. I’m sure she’s been diligently poring over the briefs the past few days.

If the Census determines the representation of each state, why would foreigners be included? If a state is over represented because of foreigners, doesn't it diminish the voice of ACTUAL Americans in their own representative government?

This is huge. It could chop California's electoral votes at the knees and distribute them to GOP states.

Don't expect this to go conservative's way. I fully expect Roberts to "swing" with the liberal side of the court Constitution be damned.

It seems to make common sense, however, those opposed claim "they have a leg to stand on" regarding the original wording of congress regarding the census. It states "the counting of all people" not just citizens.

Its ironic if you think about it. The founding fathers worded it that way so they could keep tabs on where non citizen slaves lived, now the liberals are using the wording to prevent the govt from keeping tabs on where non citizens live (and getting more fed funding and representation in congress to boot).

New York, TX, FL, and IL as well.

Also impact the federal funding of many programs. Basically its SALT all over again. Taking away something from Cali, NY they never should have had to begin with.

I don't know why we use this expensive and old-fashioned method anymore when social security already has the data to make a count.

The SS Admin itself admits millions of numbers have been stolen/misrepresented not sure how accurate that would be.

The census is far more than just a headcount, its a myriad of other questions to collect useful data.

The is a patently absurd argument.


The census is still going to count 'all the people' - it is merely wanting more information about 'the people' - like whether or not they are citizens.

I agree bandit, Im just posting what the other side's argument is. They also say it will scare illegals from filling out the form and therefore hurt fed funding when cash is doled out. WHICH IS EVEN MORE ABSURD BECAUSE THEY SHOULD NOT BE GETTING ANY FUNDING (which goes back to 61s point above).

All the better - I hope NONE of them fill out the census - let those illegal alien populations are forced to come out and identify themselves so they can be deported ASAP

The first time around the democrats got only 3/5th of a person for their slaves, now they are insisting on 5/5ths.
