What happens if the election is not resolved?

So what happens if a state sends inconsistent slates of electoral votes to Congress? The new 117th Congress must hammer all of that out in January 2021.

“It’s kind of a nightmare,” said Foley, considering potential hypotheticals. “Pennsylvania, Wisconsin sending competing submissions of electoral votes, each claiming to be the real ones from the state?”

But can Congress sort this out?
quote:

What happens if the House hasn’t picked a president by noon ET on Jan. 20? That’s the Constitutionally mandated day and time to inaugurate a president. This is where the 20th Amendment and the Presidential Succession Act kicks in.

If the House remains stymied at noon on Jan. 20, there is neither a president nor a vice president. The terms of President Trump and Vice President Pence expire. But there is a speaker of the House, next in line to the presidency.

This is where Pelosi, by statute, becomes “acting president.” Not president. But “acting president.” Whatever that means.

At this stage, we would embark on the shakiest Constitutional realm in American history. For Pelosi to become acting president, she must resign from Congress and the speakership.

How long does Pelosi serve as acting president? The 12th Amendment says the acting president holds this position until a president or a vice president (keep in mind, the vice president is ahead of the speaker in the line of succession) “shall have qualified.”

“Qualifying” means the House finally pierces its impasse and duly elected a president, in a contingent election, as prescribed by the 12th Amendment.

This is all way far gone nuts that Pelosi is even planning for this.

Pelosi is pissing in the wind. Each State Delegation in the House gets 1 vote. Republicans have more State Delegations than Democrats do.

I think she is in Marin County, which is basically an upscale SF suburb.

It is where George Lucas was set up with Skywalker Ranch. And he was blocked from expanding so he did a final “frick you” to them by pushing through a low cost house development as he was selling off the property.

One thing to consider is the Dems keeping the house. If they lose the house and we don’t know who is president at the time, would the house have to elect a new speaker beforehand?

(this scenario would never happen anyway, but if it did)

"a quorum for this purpose shall consist of a member or members from two-thirds of the states"

What if 1/3 + 1 states just didn't have any members there?

it's irrelevant bc republicans would decide who the president is based on state delegations.

"election chaos" is a given, CA. Given the knowledge in the Trump Nation Populous...it's a matter of the Sean Connery Character's statement to Elliot Ness in "The Untouchables": "What are you willing to do"? That is the real question that remains on the table.

Her district hasn’t voted for a Republican for anything - President, Congress, Governor, Mayor, state Dog Catcher, whathaveyou - since the 80s.

Hell, they voted for both Mondale and McGovern.

a last gasp tactic by Pelosi.... designed by Marc Elias, the Clinton sycophant.

Never going to happen .... and if it did, there will be citizen reprisals against corrupt politicians like Pelosi, Biden, Omar, Feinstein, Schiff, and DeBlasio ..... and no, it won’t be limited to just Dems .... nor their Media propaganda mouthpieces .... Republican turncoats will also be swept up in the revolt.

This raw grab for power, at the direct expense of the Constitutional liberties that the American citizenry is afforded, ... IS going to backfire on the Legislative Branch in particular .... and those Within it that have manipulated it for their own enrichment.

The citizenry is fed up with the corruption. Perhaps the People would oblige if the People’s Business was getting done .... but it isn’t. Nor are the People understanding of the multi-tiered system of justice and complete abuse of our nation’s surveillance powers for their personal benefits and their own ideologies ......

Thomas Jefferson predicted this scenario ..... and he also provided the effective solution to dealing with those that would seize our Liberties. Our Liberties, as provided for in the US Constitution, are entirely contingent on maintaining the effective Separation of Powers among the Executive, Legislative, and Judicial Branches of the US Government.

The each need to stay out of the other’s lanes ..... it works when they do, and it breaks down when they don’t.
