The USSC declined to fully rule on this and kicked it back to the lower court. Also, admin47 disagrees with this interpretation. It is still playing out.
What, truly, would you find to be the remedy? The USSC sure as heck doesn't properly elucidate this.

Somewhere out there Spartacus(Booker) is pissed because now he won't get a free trip to El Salvador.

You feel bad for every kid that has his parents arrested or just these because Trump?
Sorry. Your indignation is beyond selective only because of your leftist friends in the media and in Congress.

He received his last deportation order and then requested not to be sent to El Salvador in 2019. He had six years to take matters into his own hands and self deport to a place that was more to his liking.
Zero sympathy.

And yet the highest court in the land thinks you’re flat wrong.

Take it up with El Salvador. They now have jurisdiction.

Highest court in which land?
Our court has no jurisdiction over El Salvador... which has been pointed out over and again, even BY our courts.

Yes. Kids are kids. I feel bad for all of them who have rightfully or wrongfully incarcerated parents. They’re innocent kids.
When you confuse indignation and basic decency that’s a you problem.

Garcia’s attorneys need to walk back the claim that he has never been charged with a crime. That’s a material misrepresentation based on the human trafficking and domestic abuse allegations.

Dude.. TN suspected him of human trafficking...
Dude. Tennessee suspected him of driving without a lawful license...a violation of Tennessee law. They could have arrested him for that.
Anyhow...this just seems to be a fishy story to me. Although, nothing will change in Abrego Garcia’s case (thankfully he is permanently expelled from the US) it would be great fun if true just to further expose Senator Van Hollen as a fraud.

You could just scroll a bit and find what you’re looking for.

Not that it matters much, but allegations are different from criminal charges. I thought the whole point of the Tennessee story was that the Feds intervened to NOT bring trafficking charges.
As for the domestic abuse charges, why wasn't he arrested if they were filed?

It is a misdemeanor.

First Offense:
Driving without a license for the first time in Tennessee is typically considered a Class C misdemeanor. This means the maximum penalty is a $50 fine and/or 30 days in jail.
A fifty dollar fine... and OR up thirty days in jail.
They ain't gonna mess with that if the feds said, "document, take pictures of individuals, and let them go".

But what I really don’t want is for this to ever happen again. Whether it’s this admin (or any admin), cutting corners and not giving due process (in the eyes of scotus, which they unanimously agree he didn’t get) is no good.
No corners were cut. We are currently having to deal with the fallout from the last administration that based their immigration policy on the ability to walk long distances and swimming rivers.

Agreed. Given Kilmar Garcia’s history of domestic abuse, it’s a good thing he’s being kept away from his kids for their own safety.
Posted on 4/16/25 at 10:27 pm to mwade91383
See. That’s the problem. Thousands of kids daily have their mother or father or both sent away daily yet you say nothing.
Your indignation is noted but it has this air of convenience.
You are smart enough to see my point of view it’s just that you have to admit that your bitching is selective.
It’s totally understandable. Agree?

Your ego drug you into this case and it’s keeping you from exiting long after prudence has sounded the alarm. Now you’re stuck hoping a report is wrong.
