If they are not domiciled in the state, as is the case with with pending asylum cases or birth tourists, an argument can certainly be made that their state citizenship is in question.... This is the case Alito made. Of course, these people will just go to blue states where they will be allowed to feed from the host like maggots until there is nothing left.

But it doesn't matter. If a foreign national has a child here, deny any visa renewals and send them back. If an illegal has a child here, deport immediately. They can take the child with them or leave it here with American caregivers.

Here is the text.


All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

If a foreign military invaded and occupied the US, their children would be US citizens according to Roberts and ACB

Not likely. As members of a foreign military, they would be subject to the jurisdiction of the foreign nation, just as American soldiers stationed abroad are under US jurisdiction.

Should be the way it is, but of course they use the children to invoke an emotional decision.

again... the baby may be legally a citizen, but the parents can be deported, have their visa revoked, or not renewed. They can choose to take their baby home with them or leave it here, but they can't all stay.

Nothing in the ruling prevents this.
