The problem with the USSC and judges in general. when they are approved in the senate republicans want a "fair and impartial" judge. Liberals want a far left. So both get their selections through. The result...
You end up with a USSC where 2.5 of the judges are going to rule against ANYTHING that is remotely viewed as fair for the populace and against their special interests.
As another poster stated, we are a dem in office and a couple of judges from turning into Europe.

I had it on in the background, but it seemed like Sotomayor and maybe Jackson were exploring the idea that the case is moot because the plaintiff/challenger of the Idaho law had dropped out of the case.
Along similar lines it seems like the liberals might be taking the position - and will make it clear in their dissent or concurrence - that the true question before the court is whether the Idaho law properly applies to a person or persons similarly situated as the plaintiffs. The idea being something along the lines of: plaintiff has a testosterone level of X and that the State has enough of an interest in stopping such a person from competing in womens sports. But the State might not have the basis from stopping someone with level X-Z.

When it gets this far, meaning going to the SCOTUS, you have pretty much lost this fight no matter what they rule.
It's a societal issue that's never going to end. and we will slowly cave over time.

The fact that she made it to the Supreme Court only because Biden excluded 99.999% of America as candidates is shameful. That's the ultimate DEI hire and is does a disservice to blacks because it assumes they must be helped along because they are unqualified for a position.

This was because the Democrats would never have allowed a white person to fill Marshall's seat. There were only 41 Republican senators at the time. The Republicans weren't into DEI ins 1992, and they weren't getting any black votes at the time anyway. PS the Dems still tried to take Thomas out by smearing him.

I just started listening. Title XI is based on biological sex. Have any of the Justices asked whether being "trans" is a physical state or a biological one?

i am so tired that this is even an issue in the US i am beginning to think the best case scenario would be if all the guys who aren't good enough to make the mens team should just go and take over the women's teams. Imagine the WNBA, LPGA etc all being filled by men...then the left would actually wake the frick up and want to make laws excluding men from womens sports

Like it or not, Biden himself torpedoed Jackson’s credibility bc he said that the next judge would only come from a small subset of the available pool of candidates.
