First let's address the fact that there is not a single dem that will vote not to convict.

Pure politics.


They still need 17. They will get the gang.

1- Romney (is his second time to vote to convict)
2- Collins
3- Toomey
4- Sasse
5- Murkowski

The next 12 will follow Mitch's lead

Who's presiding over this vote? Leahy? Then it's unconstitutional. You can't have an impeachment trial without the Chief Justice. There is no provision in the Constitution for an alternate. Lots of people are debating whether or not you can impeach someone after they have left office. But on this point the Constitution is crystal clear. CJSCOTUS must preside. Imagine a prosecutor trying to have a trial with someone who isn't sworn in as a judge presiding. No Roberts = no trial.

This is all theater.

Even if by some miracle they convict it will appeal to SCOTUS and it is obviously unconstitutional and even Robert’s himself has said so.

That's not how SCOTUS works. It's the final court of appeal. They just don't meet and decide something on their own without a case being brought before them.

Now, the question that should be asked is why hasn't Trump's team filed a motion to stop the proceedings on this basis? He even has Roberts on his side.

After reading all these comments and following this garbage for months now, the Democrats must be scared SHITLESS of Trump. I mean they are desperate to do ANYTHING to keep the man from running in 2024. It really hit home with me tonight for some reason. I need to stop watching the news completely. All this is sick.

Trump's decision making when it comes to lawyers has never been keen. From Roy Cohn to Michael Cohen, his lawyers have been a revolving door of shadiness or incompetence. Hire a constitutional scholar like Turley and a seasoned appellate attorney to preempt this damn thing.

Doesn't matter who he hires. By the time it goes to "court" and Leahy decides, it will be 2024. Trump will appeal and it will go to the SCOTUS and get stalled. By the time they rule it unconstitutional, the election will be over.

It's a timing thing. That's it.
