As a legal question, this is an absurdity, similar to some of Biden’s obviously unconstitutional EOs. I doubt it would pull a single vote from the S Ct on this.

I don’t think either side really knows what was intended by this.
People who want to say we already have decided are implicitly arguing that Plessy v Ferguson should still be the law of the land.
AFAIK, there is no precedent that contemplated the idea of illegal aliens being here one day and giving birth.
