Possible aggravating factor that would qualify:
“The offender created a great risk of death to others besides the intended victim.”
There’s a list of a dozen or so possible aggravating factors and I think this is the only one that might be even possibly applicable.

Were they to find a way to charge him federally, then Florence Colorado SuperMax would be where he would likely go.

Remember that Utah was the first state to execute someone after the Supreme Court re-instituted the death penalty. Gary Gilmore, by firing squad.

I don't know anything about the statutes involved, but the killing of one person may not bring the death penalty there.

A lot of this "life in prison" stuff that gets tossed around on here is overblown and exaggerated. Not saying it doesn't happen, but not near to the extent fantasized on here.
