Well.. it is factual that co is full of shite and , with political motivation, determined that trump insurrected.

Just like it's factual that some woke parents have determined that their 5yr olds are transgenders.

Isn’t a prerequisite of being cleared of a crime actually being charged with said crime?

They are really going to lose it when SCOTUS confirms some sort of presidential immunity.

The SCOTUS did not address it.

They clearly did
quote:

Section 3 Disqualification from Holding Office

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

Congress has never acted on Trump in regards to J6. So yeah, they said he can remain on the ballot because he hasnt been found to be an insurrectionist

Hard to be cleared of something you've never been convicted of.

Given that they live by projection and EVERYTHING they accuse him of is what they either did, or plan to do, I suspect their “protest” at the Capitol to stop electors from certifying will make summer of 2020 look like a picnic.
The difference of course being the media spin that they are justified since they are
“Saving democracy from Hitler.”

Only Congress can invoke the insurrection clause of the 14th amendment. And they already tried to when they impeached Trump for incitement of insurrection in Jan 2021. And Trump was acquitted by the Senate.

Congress has already made their decision on the 14th amendment in regards to Trump. People are trying to rehash things that have already been decided.

Can they even impeach a former President? It seems like they couldn't since he's former

Impeachment has nothing to do with this scenario.

What is missing today is a statute similar to the Enforcement Act of 1870. Since there is no Congressional statute currently active, no person can be deemed ineligible to run for "insurrection" in the United States. Only when Congress passes another statute can the section become enforceable.

And for everyone asking about criminal charges, the Enforcement Act did not require criminal charges.

From the ruling yesterday:

quote:

That Act authorized federal district attorneys to bring civil actions in federal court to remove anyone holding nonlegislative office—federal or state—in violation of Section 3, and made holding or attempting to hold office in violation of Section 3 a federal crime.
