The permits are not difficult to obtain or maintain. It seems that in most places in NY and outside NYC, the fee for a permit is about $200 every five years and that the permits are not difficult to obtain. Basically, you cannot be a felon.

Assuming he is subject to podunk juries, the prosecutor will want no part of a trial and will be fine with a plea and no time.
