I'd rather be arrested than take the chance of something happening during a break in. The illegal weapon charge is ridiculous. This is New York though, one of the idiot capitals of the country.

An upstate New York man was charged with felony possession of an illegal handgun after he fatally shot two people burglarizing his home Tuesday afternoon

Ronald A. Stolarczyk, 64, interrupted a 57-year-old woman and a 27-year-old man burglarizing his home in Deerfield, New York

Patricia Anne Talerico died at the scene and Nicholas A. Talerico was pronounced dead at the hospital

Better to be tried by 12 than carried by 6.

Liberals want the country in chaos. They want to harass and kill off any of the good left in this country..

I wonder if the handgun was illegal because it wasn't registered with New York?
Here we go making criminals out of law abiding citizens. That is all gun laws do.

Arrested for illegally exercising his God given rights, which were constitutionally protected (in some states). Does NY have a requirement to retreat as well? If so, maybe they can stack that charge on later too.

I want to know what made him illegal to own a gun. This might be a perfect case to challenge NY gun laws

Article does not explain why it was "illegally owned" but looking up New York gun laws, you must register all hand guns, so guessing it was not registered
Edit: A few years back, one of the papers from a NE state published all home owners with a registered gun. I would use this as part of my defense, as it opens them up to privacy intrusion. also, the standard, "shall not be infringed" 2nd amendment fight.
either way, this homeowners life has been ruined in the process of defending his home and life

I would bet the gun wasn't registered properly or he didn't renew a registration or something.
