I mean he died. I guess that's good. But I think it may set a bad precedent. Even cops can't shoot fleeing suspects.

I was just asking how that would hold up in court. May be a slam dunk case. But no one can answer it so I'll let the PT have it's win.

But if the guy was leaving, I don't think legally you have a case. Sounds like murder right?

I understand... just don’t see why this needs dissecting.

It’s clear what happened looking big picture at the scene of th crime... the guy was shooting people and trying to get away... American Joe kept him from getting away.

Once and attempted murderer, always an attempted murderer. Just because he stopped shooting doesn't mean he is no longer a dangerous criminal.

It is a GOOD thing when an armed citizen confronts a potential murderer and wins.

No way! Spree shooters want the maximum effect. Most likely this shooter was dissatisfied that he didn't have more targets and decided to look elsewhere. The civilian did exactly the right thing by killing him. He may have saved scores of lives. Good on him.

what if it was as simple as the dirtbag came upon the armed citizen in the parking lot who used his weapon to protect himself and possibly others as well. why make it so complicated without more facts unless you want to place blame on someone who dared to carry a gun?

There's a lot of good people right here in my little town in OK who are armed- heavily and at all times- and you'd never know it. I might not get along with all of them, but every one of the carry permit holders would do the honorable thing and waste somebody being stupid and causing harm with a firearm.

I wish I had four upvotes to give- one for OP, one for the armed citizen, one for the 2A and a fourth for my great, gun loving home state.

Depends on the situation. A Cop can't shoot a burglar or a purse snatcher, but he can shoot someone who just committed mass murder. If someone is a danger to the public, the Cops can "shoot to kill" that person in order to prevent further loss of life (even if they're fleeing).

They can, and they have. Several of the police shootings of fleeing suspects have been discussed at length on this board.
