That is "in public". It's not a publicly-owned building, but it's a public space. He had a right to take pictures or video of anyone unless the grocery store had posted signage saying it wasn't allowed or he was asked to stop by employees. He SHOULDN'T have been taking pictures, but that's a different story. Just because it's legal doesn't mean it's right. If the dad had whipped his arse, I would fully support it for several reasons.
