So I've not been following much since they've been in deliberations -- is the long deliberation better for one side or the other?? Statistically speaking, how would you expect this to go?

Im just speculating that they cast their "prejudice" lot with the 5th amendment violation, which was pretty egregious and seemed to shock the Judge. Fast forward to day 2 of deliberations and the defense isnt feeling as confident anymore. They want to file a new motion on the video, but cant prove it was done intentionally or with prejudice, so they file without prejudice to give the judge an easy out. Its plausible.

Its not a bad strategy if that's what they were shooting for. This judge will NEVER dismiss with prejudice.

I think they're shutting it down at 4:30 today, so it looks like Monday it is.

Mistrial with predjudice means Kenosha can't try him again and Kyle is free.

Mistrial without predjudice means Kyle can be tried by Kenosha again, which is the equivalent result of a hung jury, which looks more & more like we are headed, so I have no idea why the defense would request that be granted (other than it would save a day or two of waiting on deliberations).

Should be an open and shut case, especially given the fact that the prosecution gave fuzzy evidence on purpose to the defense at the last minute. Judge right there should have dismissed , but the defense sat on their hands and so the judge just let it slide. Unbelievable.

The longer it goes, the more likely it's a hung jury. Hearing 2-4 activist jurors are refusing to clear him, because basically a white kid has zero right defending himself or property during a fake racial justice riot.

The jury was hung at selection. Just because Barnes is salty (and he is most definitely salty as frick), that doesn't make him wrong.

Yep. And about the homicide charges, it would be completely reasonable for the jurors to have speculated that life in prison is at play, and they'd be right. So it makes it even harder to believe that anyone even just close to being on the fence would say screw it and pull the trigger, if I may, when not being certain (beyond a reasonable doubt). And a mistake leading to this young fella receiving life.

The jury will likely be hung, but thats a helluva risk for the defense to take when the penalty is life in prison.

They may have given themselves another path to retry the case because they are no longer confident in the jury or they dont believe Schroeder will follow through with prejudice. If they file the same motion on the video WITH prejudice, it likely goes nowhere and Kyle's fate lies solely in the hands for the Jury. This way, Schroeder can dismiss with prejudice on the 5thA issue (he wont), dismiss for a retrial on the second motion, or leave it to the jury. If the jury intends to acquit, Schroeder will not dismiss - so this gives the defense another door out of this even if it means retrying the case.

Again, I'm speculating, but I can see a way that this move makes some sense.

Fricking people man...jury of my peers sounds terrifying. It means there are people on this jury making decisions completely outside the law.
