Here’s a thought for the loudest sky screamers amongst us: if the government wanted to abuse its capabilities to spy on its citizens for nefarious purposes, it can do that with or without FISA. This program “merely” provides an avenue for searches under certain circumstances and parameters to yield legal evidence/information that makes it legally usable in the court setting, i.e. procedurally allowable.
Now, does it take liberties with the aforementioned “parameters,” yes. But again, FISA doesn’t provide the government with some magic key to otherwise inaccessible data/information. They could have abused their advanced technology and hardware and software to “spy” on you inappropriately long, long ago, if and whenever they so choose.
This is merely crumbs for thirsty sky screamers. And none of this has been intended offensively towards yourself, or anyone else specifically, just general observation(s).
Now, does it take liberties with the aforementioned “parameters,” yes. But again, FISA doesn’t provide the government with some magic key to otherwise inaccessible data/information. Under Section 702, the executive branch must submit an application to the FISC for annual certification. POTUS can direct the AG and DNI to stop applying for or renewing these certs. Without court approval, intelligence agencies cannot operate under the program, even if the law remains.
POTUS could also issue an EO or internal directive to halt FISA. He could mandate to IAs to seek a probable-cause warrant.
I'd like to note that I'm not against FISA. Just wondered why you went out of your way to excuse the one person who could end it unilaterally.

I don’t think that’s what you’re wrong about. Let me ask this: are you familiar enough with the FISA program to be able to describe, perhaps even with some anecdotal information, the type or types of situations/scenarios wherein this particular program is, could be, or actually has been key to averting or responding to otherwise catastrophic incident/event?
In other words, have you thought through the possible benefits derived from FISA? Or rather more or less made your mind up without even really knowing those types of details from the other side of the argument? Don’t feel bad if you’re the latter…..clearly so is pretty much everyone else.

Let me be crystal clear: I want FISA dead. Not replaced… dead.
I want the Patriot Act repealed.
They’re both bad programs built on a justification of lies.
I understand fully and have looked at the logic behind and the potential consequences of ending both and found them entirely unjustified in their transfer of power and privacy away from the individual to the state.
You can be free to support handing away your rights and freedoms for “safety”. I don’t and don’t believe any of this was ever about safety in the first place.
