This is a tacit admission that they know they are losing the Senate.
It also means that they can’t afford to piss off Manchin or Sienema since this will be 50-50 with Heels Up as a tiebreaker if they pick someone contentious.

Putting a member of the current AG department in as a Justice is something that shouldn’t be done simply because of their involvement with cases that will be heard by the court.
Kagan, as Solicitor General, was bad enough because she was arguing the administration’s cases. This is the actual AG who is over making decisions on law for the administration.
