Part of this may be appeal strategy. If they don’t object and move on it now, the appellate will simply say “why didn’t council object and ask for a new trial during that trial”. Just my amateur arse guess here.

and Lin Wood will be seething because he wants to try and get his grubby hands on that sweet, sweet $2 million in bail money. Maybe the judge will deem Kyle no longer a threat and lower bail and a portion goes back.

The judge saying he won't consider throwing the case out until the jury sees their video clips they requested.

This makes no sense. Plus all the arguing about the file is dumb. Fatlock is a liar. Evidence is evidence.

These people are suppose to be smarter. This is what they do all day, every day.

So if the jury sees what they want to see and reach a verdict it will be too late for the Judge to dismiss w/ prejudice, no?

No way he is waiting on the jury and if they all say guilty then he has the nads to throw it out?

Admittedly, my knowledge of this trial are these threads, but as a lawyer, what I have heard is appalling. I don't do criminal law, but Kyle's defense seems to be making some very basic errors, to the significant detriment of their client.

I think the theory behind doing it that way is they have already submitted the request for mistrial with prejudice so now they are asking for it without prejudice, knowing it will be tried again, because that's how confident they are in their case.

The only things keeping Kyle upright are the facts of the case and that the prosecutors are worse than his defense team.

From a PR standpoint, it would depend on the vote. If it's 10-2 with 2 holdouts for acquittal, it would be extremely difficult to refile charges.

If the vote is 10-2 with 2 holdouts for guilty, then they will almost assuredly file new charges.

If it's a mistrial without prejudices, Rittenhouse will be suing them for the MULTIPLE instances of the DA's office violating Rittenhouse's civil and constitutional rights. The case would then probably be reassigned to the state's AG or another DA's office. I can't imagine another DA's office filing charges after the sh!tshow these ADA put on.

the key piece here... from the way I understand it... is that the jury has not asked to see the drone video in question

they're arguing this now b/c the jury has asked for videos and the defense is making it known that they do not want the jury seeing the drone video should they eventually ask for it to

and the judge is like 'we'll cross that bridge should we get there'
