It is going to be the issue. This guy and Khalil are going to attack the statute that authorizes the Sec. of State to remove a non-citizen when the Secretary reasonably believes that the non-citizen undermines a foreign policy objective of the US.
They are going to attack it on the basis that it denies them their freedom of expression.
I am almost certain that this statute has never been attacked on those grounds before - so we shall see.

I agree COMPLETELY with your sentiment. In my opinion most J6 protesters were abused by the judicial process.
As a practical matter, though, only judges in D.C. were responsible for those abuses.

And it only takes one somewhere to say "Ok. I agree.." and the whole thing is overturned? If I were sentenced for a federal crime what is stopping me from having these petitions filed in EVERY SINGLE COURT until I get an answer I like better?
