Is this illegal? Civilian wearing ICE "costume" to polling location in Miami

Dude strolled around Miami polling station in ICE gear he bought on Amazon. He was arrested because people were "in fear." Probably a target-rich environment: the polling station was for the BRAZILIAN election.
I can't find anything that makes it illegal if the civilian doesn't claim---or act like---they are an ICE employee. The breathless reporter said that the civilian was "aggressively walking around." Oh noes!
I hope the civilian does a public interview.
It's certainly funny. I don't think it should be illegal. Do you?

Federal law is clear at least as to wearing ICE gear. It's not illegal unless you take an action to indicate you are an ICE agent. There's even a bill circulating in Congress to make illegal what this guy did.
Florida law comes down to intent.
"The relevant law is Florida Statutes § 843.085(1). It makes it unlawful, unless authorized by the appropriate agency, to wear or display:
“any authorized indicia of authority, including any badge, insignia, emblem, identification card, or uniform”
of any federal, state, county, or municipal law-enforcement agency, or a colorable imitation, “with the intent to mislead or cause another person to believe” that the wearer is a member of that agency or authorized to wear it."

Yup. As said...target rich environment.
Whatever the restrictions are on ICE being prohibited from being at polling places for AMERICAN elections, they shouldn't apply to BRAZILIAN elections.

I could see Bill losing his mind at the polling stations if he saw this. You wouldn't say anything to the guy, but you would probably be losing it, like a good liberal.

Better question is why do we have a polling location for a foreign election in the U.S.

We have dual citizenship. Brazilian citizens must vote in presidential elections.

Because it's not even a question that we have dual citizens living here. Brazil allows dual citizenship. Were they all dual citizens? Probably not.

I don't know if that would be a fair comparison. Federal law prohibits ICE from being "at the polls." It will be interesting if ICE posts up "near the polls."

Sure, but this admin has shown scant respect for the law so I anticipate there being incidents. Probably more like those in the OP than actual ICE officers showing up, but we just have to wait and see I suppose.
