I have said repeatedly that I think that the death penalty should be applied in very narrow circumstances for the most egregious of crimes ... I think that the rape of a small child, six or eight years old, is a heinous crime and if a state makes a decision that under narrow, limited, well-defined circumstances the death penalty is at least potentially applicable, that that does not violate our Constitution.

It's easy for a guy to get unjustly convicted of pedo shite.

I get what you're saying, but don't we already have that to some extent? Not public "executions", but people are shamed online and it isn't pretty. We already have modern versions of pillories and public hangings. And with "true crime" tales flourishing online, no I must disagree. Nothing good will come from public executions.

If anything, it might even have the opposite effect. Internet will generate more sympathy for the condemned.

Is there a punishment law on the books which was not repealed after Kennedy v Louisiana and has just been sitting on the books but deemed unenforceable due to SCOTUS, or must the Florida legislature pass a new law to accomplish this end?

Here is a much better article regarding this development.

First, he is only encouraging the legislature to pass a new statute. There is not currently one on the books.

Second, he is also proposing a change in the rules regarding imposition of the death penalty in all cases. In particular, once convicted unanimously, he is proposing that less than unanimous consent of the jury be required in order to impose the death penalty.

I remember back in the 1990s Louisiana sentenced a man (Patrick Kennedy) to death for a violent rape of a four-year-old girl. The courts ruled his sentence as unconstitutional, even though the child required extensive surgery to save her life and who knows whatever sort of psychological intervention.

Maybe ask Jody Plauche if his life has been rewarding or meaningful. Hey I’d love to whack every pedo. But it’s just bad policy as it’s an incentive to murder after the rape. I’m as Old Testament as the rest of you guys, I just think the unintended consequences would be tragic.

One reason, if a single innocent has ever been executed for crime they did not commit, it should be abolished.
