If SCOTUS would like to refer to a "War" before they would be comfy with upholding this lower court decision, then the Govt should invoke the War on Terror and claim that this triggers application of the AEA.

... why can't war on terror be used for AEA to spy on foreigners who entered illegally and currently reside with no regulation within our borders to protect American citizens?

Different rulings from two courts should trigger a basis to take the case before the Supreme Court.

ONE covered airspace but it also included the activation of Guard and Reserve forces for HLD/HLS missions after 9/11...

In most cases they used the AEA to do so, especially with the Mafia. They will lie today and say they did not, but I remember it clearly. I also remember Ted Kennedy giving a speech supporting it and taking flack when IRA members were sent packing.
