If Smith is lucky he’ll just get himself and his efforts laughed out of Court of Appeals, a relatively more subdued event. That’s on possibly multiple grounds

No it wasn’t. It wasn’t an insurrection, but it was an embarrassing, ugly, violent, property destroying demonstration. This is the sort of lawlessness the left specializes in, and we demeaned ourselves, at Trump’s insistence, by lowering ourselves to their level.
You can make the argument that what’s good for the goose is good for the gander, but you cannot credibly whitewash it by calling it “the Sunday afternoon BBQ it basically was”. It wasn’t.

I'm not a fan of Trump. But, trying to convict him of insurrection or related activity is a fricking LA to Boston stretch. Going after him because he did not call off the rioters immediately may be the game plan, but I doubt it would stick and certainly if that was the only count they could get through would be smacked down probably in the DC circuit much less the USSC.
Smith would have to establish a conspiracy in order for any of this to happen. His problem is, that there are already convictions for J6 with appeals outstanding. If he indicts it would be interesting to see what he has from others. I suspect that Trump is not the only target. He is also going for aides and some other elected Republican officials. They will try to flip the House before the election by indicting other Republicans. Get Republican lawmakers to resign because of indictment a la Tom Delay.

Rand Paul is probably the national political figure who is most-closely aligned with my views. I like Ted Cruz constitutionally, though he is a bit too SoCon socially for my taste. He was my candidate in 2016, bc I knew Paul was a non-starter in the larger GOP primary electorate.
