IMO America right now is poised to embrace tyranny. Just like the Germans embraced Nazism. Every German knew what was in those trains passing by their homes in the middle of the night. But they were willing to accept the genocide of the Nazis because the German economy was raging and the trains ran on time. The Nazis gassed 6 million Jews - America has aborted 67 million babies and counting. That disturbing statistic does NOT bode well for the future of freedom in America.

A recent survey provided disturbing evidence of the decline of American support for the Jewish nation of Israel. The survey asked Americans - would you support dismantling (by Islamist I presume) Israel in exchange for lower energy prices? A stunning 40% of Gen X'ers said "yes".

Like I said we're on the eve of tyranny.

PR/TT only take a routine court order, not a warrant. Only has to be relevant to a criminal investigation.

Smith v. Maryland, a decision made when the world was still on the old POTS/analog phone systems, established the "third-party doctrine" (essentually that users lose a reasonable expectation of privacy over routing data -like phone numbers- which are voluntarily shared with service providers).

Since then we've had Carpenter v. United States and Chatrie v. United States, which have chipped away at the doctrine you're pointing to.

In Carpenter (2018), the Court ruled that historical cell-site location information (CSLI) requires a warrant. The Court explicitly stated that the third-party doctrine does not automatically apply to the qualitative realities of the digital age, where data forms an "exhaustive chronicle" of a person's life. This would mean any geo-tracking Smith's group did via the information from a pen register was illegal.

In Chatrie (2026), the Supreme Court formally extended these protections to cloud-stored digital footprints, ruling that geofence location data held by third parties (like Google) is protected under the Fourth Amendment. The Court clarified that sharing data as an unavoidable byproduct of participating in modern life is not a "meaningful, voluntary disclosure" under Smith. That said, the investigation was well before this case so it wouldn't apply. I include it only to further show how Smith shouldn't (and increasingly doesn't) pertain to digital communications.

With all that said, while logging a phone number doesn't inherently reveal what an attorney and client talked about, using a pen register to systematically map out a defense team's network can pierce ACP. Knowing when a client calls a specific lawyer, how long they talk, and which specialized co-counsel is subsequently looped into the call chain maps out the defense's strategy. If a prosecution team gains access to this network mapping, a judge can deem the entire data gathering illegal and disqualify the case.

And that's if they are just using metadata. If they went beyond that like capturing extensions dialed after reaching a law office, for example, that is considered communication content instead of metadata and it's not covered under a pen register.

Absolutely. I am old and I am sick. I'm approaching the end of my pilgrimage on this earth. I don't have much time left. But I'll say this - I've spent my life trying to convince people to embrace Jesus Christ Crucified. He alone is the perfect model for freedom. The freedom to love your neighbor and treat him the way you would like to be treated. Respect for the dignity of human life is the basis of true freedom.

I recall reading about the intense deliberations of our Founding Fathers of Our Country. At one point there was an impasse - as in disagreement as to how this new system of government was to be fashioned. So what did they do? They took three months off and prayed. They prayed for guidance from The Almighty.

What they delivered was this amazing Constitutional Republic Free Market System of Government. Complete with a clearly defined Bill of Rights. No one had ever done anything like that in the history of mankind.

Then they fashioned a Declaration of Independence and each man signed his name to that document. Many of those men would eventually loose everything - even their lives. Read for yourself the sacrifices of General George Washington and those brave Patriots during that brutal bitterly cold winter as they battled to wrestle freedom from the Crown.

We owe it to those brave men to fight.
