I've never reviewed Birmingham's, so maybe I'm wrong. Based on their track record, you're probably right. The cities I've dealt with absolutely do follow up on the submitted bids from minority owned contractors. And those are just a few ways they do. From my conversation with one city's attorney, a lot of cities have started more due diligence.

One of the problems is there aren't enough good minority contractors in Birmingham any more. They've either folded or can't qualify to get the work. So what you end up with is BCIA forcing GC's to use subs that they know can't do the work then they have to get a qualified company to come in behind the minority that they were forced to hire and you wind up with one big cluster.

And now expect Top Golf to sue the shite out of their GC. I am a project manager for a Design/Build firm and we have this put on us quite often when building in bigger cities. It's annoying work, but all you have to do is reach out to the local W/MBC association and get a list of supply houses to contract with who then turn around and hire the non W/MBC contractor to actually do the work. It's a scam, but it's the game we must play.

DBE requirements are a joke.
worked on some project in New Orleans for the RSD and they had a minority participation requirement. So we just wrote a subcontract to a woman/minority owned business to purchase all our equipment, and she took a 5% cut. so the school system in essence paid 5% more for all their equipment and no benefit.....

You can't just claim it. You must apply to be accepted into one of the W/MBS associations. They will come to your office and interview to make sure it's not a hoax.

Birmingham area politics have been corrupt for as long as I can remember, and I remember back to the 70s.

I think it's stupid to mandate that type of hiring, but at the same time they went and got involved with the contract. Either they knew and failed to adhere to the stipulations, meaning a breach, or they didn't know because they were ignorant.
It's a law that needs to be done away with, but that doesn't excuse being stupid in dealing with it either.
