I've never reviewed Birmingham's, so maybe I'm wrong. Based on their track record, you're probably right. The cities I've dealt with absolutely do follow up on the submitted bids from minority owned contractors. And those are just a few ways they do. From my conversation with one city's attorney, a lot of cities have started more due diligence.

One of the problems is there aren't enough good minority contractors in Birmingham any more. They've either folded or can't qualify to get the work. So what you end up with is BCIA forcing GC's to use subs that they know can't do the work then they have to get a qualified company to come in behind the minority that they were forced to hire and you wind up with one big cluster.

Birmingham made it extremely hard to do business with them.

USAF says the documented work must be equal to or greater than 51%, so our company will do the heavy lifting and the new company will get the administrative and field stuff for a 30-40% increase in cost.

So the largest increase in the cost is to document and proove said company is in fact doing at least 51% of the work.

If there's ever any SERIOUS discussion about reparations, shite like this needs to be taken into account.

And now expect Top Golf to sue the shite out of their GC. I am a project manager for a Design/Build firm and we have this put on us quite often when building in bigger cities. It's annoying work, but all you have to do is reach out to the local W/MBC association and get a list of supply houses to contract with who then turn around and hire the non W/MBC contractor to actually do the work. It's a scam, but it's the game we must play.

The parent company I now work for is losing a contract because the DOD says the winner of the follow on contract must be a minority or female owned company. The company just received a bridge contract to allow the DOD time to find a minority/female owned business, because there is only one minority owned business that can perform the job, you guessed it, banned from DOD contracts because of shady performance.

Time for your top management team to become familiar with Bruce Gender and put on their big girl dresses.

Same for Top Golf and their contractors. If Rachel Dolezal can be black so can anyone. As long as none of them claim to be Native American they can claim any racial background they like, or maybe part of the alphabet soup will qualify them also, take their pick LBTQabcdefg.

sounds like they knew what they were getting themselves into. No sympathy here.

Topgolf is at risk of losing $1.5 million in financial incentives it received from the city of Birmingham to build a 65,000-square-foot facility near the Birmingham-Jefferson Civic Center Authority downtown.

They probably saved 3 times the amount of 1.5 million by not hiring "minority contractors"

Why not just hire the contractors they used to fix the Jefferson Co. sewers?

DBE requirements are a joke.

worked on some project in New Orleans for the RSD and they had a minority participation requirement. So we just wrote a subcontract to a woman/minority owned business to purchase all our equipment, and she took a 5% cut. so the school system in essence paid 5% more for all their equipment and no benefit.....

You can't just claim it. You must apply to be accepted into one of the W/MBS associations. They will come to your office and interview to make sure it's not a hoax.

Not sure if this is just a jab at Jefferson County or not but it wouldn't be many of the same types of subs from the sewer job to this job.

I don't understand why they are putting this in the city in the first place.

It was a jab.

Birmingham area politics have been corrupt for as long as I can remember, and I remember back to the 70s.

No sympathy either way.

I think it's stupid to mandate that type of hiring, but at the same time they went and got involved with the contract. Either they knew and failed to adhere to the stipulations, meaning a breach, or they didn't know because they were ignorant.

It's a law that needs to be done away with, but that doesn't excuse being stupid in dealing with it either.

Agreed.
