Yeah but you can’t interrupt and disrupt a prayer service for Journalism either…or speech…or to practice your own religion.

It’s not the protesting that makes it illegal. It’s the disruption of someone’s else’s ability to exercise their own 1st amendment right.

My question is what constitutes a journalist today? I wouldn’t consider recording something on your phone for insta, YouTube etc a journalist. Most folks in that “protest” could make that claim. Secondly, a true journalist should report without biases. Not sure anyone would accuse Don, Abby or most folks at CNN of being unbiased. They wear their politics own their sleeve.

You aren't comparing apples and apples. Shirley knocked on doors of daycares and asked questions.Daycares aren't protected entities like a church. Don barged into and interrupted a church, a protected entity by law terrorizing its members. VERY different. Do you not see borh the legal and contextual differences?

You're an absolutely insufferable human being, but this is spot on. Don Lemon is a piece of shite, but he was legitimately doing journalistic activities there and wasn't participating in causing the chaos.

It’s an absurd argument that one can’t commit a crime because he happens to be in the act of exercising a right.

And a TON of people, here have accepted that premise and have tried to argue that he wasn’t being a journalist. It doesn’t matter. He committed a crime while being a journalist.

Weeeellllll...there are at least 12 precedent cases, almost identical to this (read protesting protesting and interfering with active church services from inside the church) on the books for FACE Act alone.

We also know judges are prone to play political games.

Fines are the most common penalty, but jail time up to 10 years is the max.

Not for trespassing on private property. Not even if all you do is stand there and film.

Megan Kelly made a good point on her podcast by comparing it to an abortion clinic. As a reporter, she couldn't walk inside an abortion clinic even if she was overing protestors who went inside. They'd be guilty of a federal crime just for going in, much less blocking entryways and exits and screaming at people, and she'd be guilty along with them for going in.

And that's the same federal law that Lemon broke. The FACE Act. It protects places of worship as well as abortion clinics.

Wrong again. This isn't an expansion of prosecution. It's not a new precedent. Biden prosecuted the hell out of protestors violating the FACE Act at abortion clinics. It's been around since 1994.

If they DON'T prosecute these people, THAT would be a new precedent. Because protestors will start showing up at abortion clinics and going inside and yelling and blocking exits.

he said on camera in the car “we cant go inside, let’s stay outside and record it

then he went in and participated in the disruption

which means he knew it was illegal and did it anyway
