Smart move. The auto pen criticism of Biden is good for scoring all the political points you can, but since Biden has claimed to have made the call on all of those signatures, there’s not much that can be done legally.
I can have my dog sign something for me with a paw print and it would stand as long as I intended for it to be my signature.
If the argument is that Biden lacked capacity, the method to attack that was the 25th amendment, which was never invoked.
No Court is going to strike a president’s signature based on capacity grounds, or strike a signature for not being legit when the president has publicly said he backs that signature. That’d be overstepping by the judiciary.
So if you want to criticize anyone, it’s the GOPers in Congress who never tried to 25th Biden when it was clear it needed to be done.
