Okay, you're going to make me walk you through this step-by-step.
WHY is the State threatening the local officials? Because they're trying to elect a Clerk of Court after the State Legislature abolished the office of criminal clerk and transferred those duties to the civil clerk. I understand you disagree and disapprove of that action, but that's beside the point; the legislature had the constitutional authority to abolish the office and they did; this thread isn't about whether that was a good idea or a bad idea, its about the AG "threatening the local officials" if they call an election.
The question, therefore, is whether those local officials have the authority to appoint an interim clerk and call an election for replace Ms. Napoleon during her term of office as established by state law? If the answer is "no" the local elected officials are acting illegally and the AG was simply doing her job when she "threatened" them. So what's the point of this thread (other than the fact that it gives you a platform to complain about what the legislature did)?

I have been honest. His office was abolished because it was a pointless waste of money. Yes.
He KNEW it was going to be abolished when he ran. So did everyone else. How did they know that? Because it was broadcast plainly.

The clerk of court does nothing. They’re a repository of records. That’s it.

But since you know so much about practicing law, I will defer to you and tell him he absolutely does not need the clerk’s office any longer- and it could be run by preschoolers.

I have legitimate questions about this: does the legislature have the ability to appoint (or declare by law) COC for every parish? It seems like it likely does. Why don’t they?
What discretion or framework was used to determine Civil should absorb Criminal’s duties and not vice versa? Do you think that’s relevant?

The legislature passed a law preventing him from assuming the office to which he had already been elected. In the name of efficiency, the State rendered that election politically meaningless by abolishing the office immediately before the elected official could assume it, despite the election itself already having occurred.
