Try to work it out with them normally. If they don't budge, have an attorney take it before a competent judge, if one exists in your county or parish. The landowner of record will be granted legal access.

If I were you and ended up having to hire an attorney to gain access, I'd immediately realize that my family members are horrible drivers, and a minimum width easement of 75 feet would ensure the continued safety of said family members and neighbours. (OP - 15' is way too narrow.)

After getting a legal easement, I'd also put the biggest FSBO sign in the world on it, and spend a lot of weekends "showing" the property to a bunch of bums from the streets. I'd be such a good neighbor, I think I'd probably go and knock on their doors with said bums and ask to use their bathrooms... Don't wanna kill the grass.

But that's just my opinion, man. You probably shouldn't take advice regarding property rights from me... My old neighbor was a Chalmettian.

Let it leak that since you can't build you are selling to the parish for a sewerage treatment facility.

OP and his family are the ones creating the landlock situation. Neighbors don't have to sell them shite nor do they have to give him ROW.

A) Stop talking to neighbors about it
B) Talk to a real estate attorney pronto
C) Draw a got dang ms paint illustration and tell us why you can't go through your family's property to a road.

By selling you this, they risk having trashy and loud neighbors.

You may or may not be... and whoever you sell to, may or may not be, etc.

If you want it bad enough, you'll offer more. Maybe enough, maybe not...

Good luck with your free land.

that’s why we’re offering to buy the strip for fair market value.

Why would they want to sell at market value? You are going to be building a driveway and that would decrease their property value.

You need to offer them enough to off-set the decrease in their property value; market value is not in play for your scenario.

Yall -- I realize I have no legal course of action here. Just was wondering if anyone has had any experience in this situation and what was done about it. I know what we're wanting to do is a long shot.

If I end up gaining access another way, I'm putting my septic tank on their side of my property. Just in case it ever backs up and overflows.

That's exactly why they won't sell you the land. 99% of the time you get shitty neighbors.

Clearly that was a joke. I'm not trashy. I'm trying to get away from trash. I got a family to raise in peace and harmony.

Yeah, because they really should sell you a strip of their land because you won't put a driveway on the family property in case you sell some of it so you can avoid potentially sharing a long driveway to neighbors you don't like. Makes sense.

I think you should put the driveway on the family property and take the risk.

Do they live there?

No. Otherwise they would have access. They sold their home and kept the property behind it.

Now they want to let their trashy kids build on it.

Nope.

They still have access to it, VIA 2000 feet of wetlands which they own. Good luck driving through it.

Heard of 2 similar cases in communities where I worked on projects.

Bad first, property owner got parish to buy ROW (told owner some BS) and build a quasi-public road (don't ask). Basically dirty small town politics, ended up in court, not sure what eventually happened.

Good, property owners got together and found some common ground. Granted servitude of access near existing utility servitude, negotiated tree grove built to block view to side of house along servitude and also relocated overhead lines to subsurface conduits.

Be nice and try to negotiate.

Yeah cause that's a totally reasonable response to someone not wanting to sell off part of THEIR land that THEY bought. Pfft.

You are a fricking idiot. You have 3-4 attorneys in this thread trying to pry enough information from you to give you some advice, but your dumbass refuses to give the necessary information.
