I'm saying income generated during the term of the marriage is community property and idgaf if it's income generated from running a family business. That's community property and frick no I'm not signing something that says orherwise.

Did you tell your daughter? Because regardless of whether or not you intend it, he’s going to think she knew about it and it will cause problems in their relationship...just saying. Seems like a super shitty (and trashy) thing to do at all, and especially not in private

Are you a lawyer? I'm not, but I've been involved in my fair share of multi million dollar family property discussions.

As said, you are making a HUGE assumption that the company does not grow. Any growth would be community property. Any income while together would be community property. Furthermore, a pre nup would make things very very clear. It would be a complete cluster of a divorce in a situation in which a business is inherited and both husband and wife work there.

So yeah, while I may not be a lawyer if there is a business involved that was established before the marriage a Pre Nup should frankly be a necessity.

If you can't understand that as the spouse that needs to sign it, then frankly you probably don't need to be married. Its about passing on through the family.

Transferring a private business through generations is extremely difficult. Especially when it is a female heir that may not be the President/ CEO due to not working full time.

No, but I dealt extensively with property rights and probates when I was a Landman for 6+ years. I know inheritance laws pretty well. Admittedly more so in terms of real estate. But in terms of mineral rights, the money paid off them would be community, but in a divorce, the actual rights would go to who inherited them.

You lost me here. Explain. It’s my understanding as long as she pays herself a competitive salary, the guy wouldn’t be able to claim ownership in the company by virtue of their community property earnings being put back into the company.
