In many cases, this argument is valid. The OP's question is valid, though, because smoking and vaping affects everyone around the trashy individual who is doing it. Many people don't want to smell or inhale assholes' second hand cigarettes or blunts. Keep that gross shite inside your house. Many people also don't want to smell fruity flavor vapers lingering in the air.
