I feel bad for the OP. Some ppl are just too nice in a bad situation and they get taken to the cleaners. I've never seen a divorce be friendly. If there's anything he can take he'd better do it now. Better to take and make the judge tell you to return it than sit on your hands and let her take it all.

I'm not a lawyer, this is not legal advice, and you might not be able to do a damn thing, but no way I would let her just hold that money without a fight
But, he did sleep in a Holiday Inn Express last night...

If it is a community property state, what ever was in the accounts on the date of file for divorce you are each entitled to half. If she took all of the savings, then she will have to give you half back once property is settled. Get your own attorney.

Joint accounts are huge troubles in divorces.
I know folks that work at banks and they'll tell me of the husband (or wife) come to the bank when it opens and drain out the monies in the account. An hour later, the other one shows up wanting to do the same.
He who hesitates is lost.

She's a woman. It's a divorce. She has your money in her possession. You're screwed.
The courts MAY say that she owes you any money spent but if there's no restraining order and/ or if she can't repay it then you'll be out

Why did you not take out half when you filed? That makes no sense.

All court doctrine dictates they do shite equally. 90% of all domicillary parents are women. 90%!!!
You may not be screwed but i wouldn't count on what the legal doctrine says. They do what they want

You guys must not be familiar with MDAs but until I sign that nothing is official. If half the money isn't on the MDA then I'll go to court. A judge isn't going to allow her to keep all the money in a no fault divorce
First thing you should have done when you knew you were getting divorced was read the monthly thread on here about people getting massively fricked over in divorces.

There are some brilliant legal minds in this thread. Lol.

Until you're formally divorced she has every right to drain every cent from that account.
Chances are slim you will not be seeing that money again. She can either spend all of it or hide it.
Either way start putting your paycheck into a separate account.
Why have a mutual savings account where only one can withdraw the funds?

You, my friend, are about to find out why joint banking accounts are a bad idea. Live and learn.

add you to the short list of florida fans i'd want to drink a beer with, and i'll buy the first round.

You should be emailing her about this in order to keep a record of what she is saying. I would also go to the bank and get copies of the closing withdrawal.

Because that's 70 thousand bargaining chips she's holding to make sure she can manipulate OP into exactly what she wants.
