Assets are valued at the time of filing. She can take the money out, but if she spends it and forces you to litigate to get any of it, she will likely also have to pay your attorney fees. But seriously, get a lawyer. The first call said lawyer would make would be to opposing counsel to get validation that the money was in the account. He would then likely require it be placed in a trust account so that couldn't be touched. If one penny was missing from the total amount, your lawyer would then file a Motion for Temporary Relief, wherein the court would prohibit all parties from disposing of marital assets. Point is, get a lawyer.

Oh man that sucks arse. I have no advice other then stop posting here about it and other social media outlets.

Hearing these stories is why I want to do a prenup before my wedding in August.

Germ town definitely screen shot any text you have or can get her saying she will give you half. If she has not sent you anything already she might not now since her lawyer probably told her not too.

How much money? I would just subtract it from the debt. If she takes more of the cash assets, then she can have more of the liabilities. No biggie. Just mark the amount and date.

Yea all this time we thought he was dealing with about $1000 or so. Not 70k.

This is how bitches get kilt and are partially responsible.

She answered my call today and said the money division would be in the MDA

Then why in the hell did she deem is OK to move ALL of it under her control? Tell her to split that shite like it's going to be listed in the MDA and send it back. Then, signing the MDA is just finalizing the transfer. You'll have your part though. There's no reason for her to have all of it now pending the signing of a piece of paper.

I hate when people post these threads about their divorce troubles, but don't post the juicy details of what lead to the divorce.

Dude, Please stop trusting her.

Please get an attorney, please take a printout of a bank statement showing how much was in the joint account the day she withdrew it all to said attorney.

The first one that gets mean, wins.

I was nice once and mean once.....

I would assume there is some distrust on her side. I bet OP has money issues.

I've been through two. I have said this many times.

During divorce #2, Wife #1 took me to court for more child support. It was a no-brainer and my support was upped by $250 a month.

I walked out of that courtroom in a daze thinking only how I planned to murder them both. Not even sure where I was going when I left the courtroom in my car, I mindlessly pulled into the Papa Johns parking lot and applied for a Driver Position b/c I was going to need a second job.

TLDR Everyone wants to kill an ex for shite like that. Sane people don't.

Because that's 70 thousand bargaining chips she's holding to make sure she can manipulate OP into exactly what she wants.

My ex and I filed for divorce a few months back. No fault/irreconcilable differences. When we filed I signed that property would be equitably divided. I was told by her attorney that I'd be getting a MDA, marital dissolution agreement but haven't gotten it. My ex just took out all the money in the savings account and put it into a new bank account. She says once the MDA is signed then she will send half of it. Should I be worried here? I mean no way the Judge would just allow her to keep all the money in an irreconcilable differences divorce right?
